1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and OctoSEC AS ("OctoVPN," "we," "us," or "our"), a company registered in Norway with its principal place of business in Kristiansand, Norway.

By accessing or using our VPN services, website, applications, or any related services (collectively, the "Services"), you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

2. Eligibility

You must be at least 18 years old or the age of majority in your jurisdiction to use our Services. By using our Services, you represent and warrant that you meet these eligibility requirements.

If you are using the Services on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

3. Description of Services

OctoVPN provides virtual private network (VPN) services that encrypt your internet connection and route your traffic through our servers. Our Services include:

• VPN connections using WireGuard and OpenVPN protocols
• DDoS protection for your connection
• Access to servers in multiple global locations
• Cross-platform applications and configuration support
• CoD VPN (DNS-based matchmaking service for gaming)
• Private dedicated VPN servers

4. Account Registration

To access certain features of our Services, you may need to create an account. You agree to:

• Provide accurate, current, and complete information during registration
• Maintain the security of your account credentials
• Promptly update any information to keep it accurate
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account

5. Acceptable Use Policy

You agree to use our Services only for lawful purposes and in accordance with these Terms. You agree NOT to use the Services to:

• Violate any applicable local, national, or international law or regulation
• Transmit any material that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
• Distribute malware, viruses, or any other malicious code
• Engage in any form of illegal hacking, unauthorized access, or cyber attacks
• Send spam, phishing emails, or engage in fraudulent activities
• Infringe upon intellectual property rights of others
• Distribute child sexual abuse material (CSAM) or engage in any form of child exploitation
• Engage in activities that could harm OctoVPN's network, servers, or other users
• Attempt to circumvent any security measures or access restrictions
• Use the Services for any commercial purpose without our prior written consent

We reserve the right to terminate or suspend your access to the Services immediately, without prior notice or liability, for any breach of these Terms.

6. Subscription and Payments

6.1 Subscription Plans

Our Services are offered on a subscription basis. Current pricing and plan details are available on our website. We reserve the right to modify pricing with reasonable notice to existing subscribers.

6.2 Payment Processing

Payments are processed through Stripe, a third-party payment processor. By making a payment, you agree to Stripe's terms of service. We do not store your complete payment card information on our servers.

6.3 Automatic Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled before the renewal date. You can cancel your subscription at any time through your account settings.

6.4 Refund Policy

We offer refunds in accordance with applicable consumer protection laws. For EU/EEA customers, you have the right to withdraw from the contract within 14 days of purchase without giving any reason, in accordance with the Norwegian Consumer Purchases Act (Forbrukerkjøpsloven) and EU Consumer Rights Directive. To exercise this right, contact our support team.

7. Intellectual Property

The Services, including all content, features, and functionality, are owned by OctoSEC AS and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial purposes in accordance with these Terms.

8. Privacy and Data Protection

Your privacy is important to us. Our collection and use of personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

Zero-Logs Policy: We do not monitor, record, log, store, or share any user activity, connection logs, IP addresses, browsing history, or any data that could be used to identify what you do online while connected to our VPN.

9. Third-Party Services

Our Services may contain links to or integrate with third-party websites, services, or applications. We are not responsible for the content, privacy policies, or practices of any third-party services. Your interactions with third-party services are governed by their respective terms and policies.

10. Disclaimers and Limitations of Liability

10.1 Service Availability

We strive to provide reliable Services but cannot guarantee uninterrupted or error-free operation. The Services are provided "as is" and "as available" without warranties of any kind, either express or implied.

10.2 Limitation of Liability

To the maximum extent permitted by applicable law, OctoSEC AS shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or in connection with your use of the Services.

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

11. Indemnification

You agree to indemnify, defend, and hold harmless OctoSEC AS, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on our website and updating the "Last updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Norway, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or the Services shall be resolved through the courts of Norway, with the venue being Kristiansand District Court (Kristiansand tingrett), unless otherwise required by mandatory consumer protection laws in your jurisdiction.

For EU/EEA consumers: You may also be entitled to bring claims in the courts of your country of residence in accordance with applicable EU regulations. Additionally, you may use the EU Online Dispute Resolution platform at https://ec.europa.eu/consumers/odr.

15. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.

16. Entire Agreement

These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and OctoSEC AS regarding the Services and supersede all prior agreements and understandings.
